Please read these Terms of Service ("Terms") carefully before using https://gutterfit.com (the "Site"), operated byGutterFit.com ("GutterFit," "we," "our," or "us"). By accessing the Site or submitting a quote request, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.
1. What GutterFit is (and is not)
GutterFit is a free online referral service. We collect quote requests from homeowners and property managers and forward them to independent, third-party gutter contractors ("Contractors") who serve the requested area.
GutterFit is not a contractor. We do not perform, supervise, or guarantee any gutter installation, repair, cleaning, or other work. We are not a party to any agreement between you and a Contractor. We do not set prices, schedules, or warranties.
2. Eligibility
You must be at least 18 years old, located in the United States, and the owner of the property or authorized to request services for it. By submitting a request you represent that this is true.
3. Your quote request
- You agree to provide accurate, current, and complete information and to update it if it changes.
- Submitting a request does not obligate you to hire anyone, and it does not obligate any Contractor to provide services.
- We try to match every request with one Contractor, but we cannot guarantee a match, a response time, or that a Contractor will be available in your area.
- Any estimate is provided by the Contractor, not by GutterFit, and may change after an on-site inspection.
4. Consent to be contacted
By providing your phone number and email address and submitting the form, you give your express written consent to receive calls, text messages (SMS/MMS), and emails from GutterFit and the matched Contractor about your request, including messages delivered using an automatic telephone dialing system or an artificial or prerecorded voice, even if your number is registered on a national or state Do Not Call list. Consent is not a condition of purchasing any goods or services. Message frequency varies; message and data rates may apply. You may revoke consent at any time by replying STOP to any text message, by asking the caller to stop, or by emailing privacy@gutterfit.com.
5. Independent Contractors
Contractors are independent businesses that are not employees, agents, partners, or joint venturers of GutterFit. We ask Contractors to confirm that they hold the licenses and insurance required in their state, but we do not continuously monitor their status, work quality, pricing, or conduct. You are responsible for verifying a Contractor's license, insurance, references, and written contract before hiring. Florida license status can be checked at the Florida Department of Business and Professional Regulation (myfloridalicense.com).
6. Disclaimer of warranties
The Site and the referral service are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. GutterFit does not warrant, endorse, or guarantee the quality, safety, legality, timing, or pricing of any services provided by Contractors, that the Site will be uninterrupted or error-free, or that any request will result in a match or a completed project.
7. Limitation of liability
To the fullest extent permitted by law, GutterFit and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, property damage, personal injury, or disputes arising out of or related to your use of the Site or any services performed by a Contractor. In no event will GutterFit's total liability to you for all claims exceed one hundred U.S. dollars ($100). Some states do not allow certain limitations, so some of the above may not apply to you.
8. Indemnification
You agree to defend, indemnify, and hold harmless GutterFit from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or any dispute between you and a Contractor.
9. Acceptable use
You agree not to submit false, misleading, or fraudulent requests; to use the Site for any unlawful purpose; to scrape, copy, or reverse-engineer the Site; to interfere with its security or operation; or to submit requests on behalf of another person without their permission.
10. Intellectual property
The Site, including its text, design, graphics, logos, and code, is owned by GutterFit or its licensors and is protected by copyright, trademark, and other laws. You may use the Site only for its intended purpose and may not reproduce or distribute its content without our written permission.
11. Third-party sites and services
The Site may contain links to third-party websites or rely on third-party services (such as form processing and analytics). We are not responsible for their content, policies, or practices.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law principles. Before filing any claim, you agree to first contact us at support@gutterfit.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Orange County, Florida, and you consent to the personal jurisdiction of those courts. To the extent permitted by law, you agree that any claim must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.
13. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users, Contractors, or GutterFit.
14. Changes to these Terms
We may modify these Terms at any time by posting a revised version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. General
These Terms, together with the Privacy Policy, are the entire agreement between you and GutterFit regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent.
16. Reviews
Only homeowners who hired a contractor through GutterFit can review that job, using the private link we send after the work is done. By sending a review you confirm that you hired the contractor, that the review is your own honest experience, and that you received nothing in exchange for it. You grant GutterFit a non-exclusive, royalty-free license to publish, display and quote your review, with the name and city you entered, on the Site and in our marketing.
We publish positive and negative reviews. We may remove a review only if it is spam, abusive, discriminatory, contains private or confidential information, or is not about the job. Contractors cannot pay to have reviews written, changed or removed.
